Commercial casinosLiveMay 26, 1978Monopoly StateStatewide 1976 referendum restricted commercial casinos to Atlantic City only (a geographic monopoly); a 2016 ballot measure to expand casinos elsewhere in NJ was rejected 77%-23%. Nine casinos currently operate, all in Atlantic City.

Historical horse racingNot authorizedNo statute authorizes historical horse racing (HHR) terminals; racetrack operators and industry attorneys have discussed the HHR model (and its potential overlap with prediction markets) but no NJ track has deployed HHR machines.[6]
Sweepstakes casinosProhibitedDual-currency online sweepstakes casinos (Chumba, LuckyLand, Pulsz, McLuck-style platforms) were banned effective Aug. 15, 2025, when Gov. Murphy allowed A-5447 to become law without signature under the 45-day rule. Penalties are $100,000 for a first offense and $250,000 for subsequent offenses, per day. A narrow carve-out remains for genuinely free-to-play promotions with no purchase requirement and prizes capped at $20 in merchandise/food, which covers conventional "social casino" apps.
P.L.2025, c.128 (A-5447)
[7],[8]
Prediction marketsContestedDGE sent cease-and-desist letters to Kalshi and Robinhood on March 27, 2025, alleging unauthorized sports wagering (citing NJ's constitutional ban on betting on in-state college teams/events). Kalshi sued in federal court; on April 28, 2025 Judge Edward Kiel enjoined DGE from enforcing against Kalshi's sports-related event contracts, holding the CEA gives the CFTC exclusive jurisdiction. DGE appealed; on April 6, 2026 a divided Third Circuit panel (2-1) affirmed the preliminary injunction, holding the CEA both field- and conflict-preempts NJ's gambling law as applied to Kalshi's sports-related event contracts and that those contracts are CFTC-regulated swaps. The ruling is preliminary; the case returns to the district court on the merits, and NJ was reported to be seeking Supreme Court review. New Jersey sits in the 3rd Circuit (with DE and PA); this 3rd Cir. panel decision is binding circuit precedent there pending any further review. Other states (NY, CT, RI and others) have brought parallel Kalshi/prediction-market actions raising the same CFTC-preemption defense, but those suits are in other circuits and are tracked in each state's own file rather than cited here.[9],[10],[11]
Skill gamesLimitedMonopoly StateNew Jersey's Division of Gaming Enforcement adopted (temporary, later permanent) regulations letting the state's Atlantic City casinos place skill-based gaming devices on their licensed casino floors, mirroring a similar Nevada framework: the rules require a minimum payout percentage and bar casinos from dynamically adjusting a device's difficulty based on a player's perceived skill level during play. This is a narrow, casino-floor-only authorization under the Casino Control Act/DGE licensing regime, not a general carve-out. No NJ-specific statute, litigation, or enforcement action concerning unregulated "grey machine"/skill-game devices outside licensed casinos (the Pace-O-Matic-style controversy seen in PA, VA, KY, GA) was identified; such devices would fall under New Jersey's general gambling-device prohibition (N.J.S.A. 2C:37) absent casino licensure.[12],[13]
Card roomsNot authorizedNo standalone card rooms outside the nine licensed Atlantic City casinos; informal "social gambling" among equals with no house cut is permitted and unregulated.[1]
Lottery couriersLiveDec 2019CompetitiveNJ and NY are the only states with an explicit courier-registration regime. Jackpocket was the first registered courier (Dec. 2019). A 2025 NJ Lottery rule proposal (effective mid-2025) updates licensing, insurance, financial reporting and moves registration to a 3-year cycle; pending bill A6081 would let registered couriers sell e-instants and create a self-exclusion list.[14]
Pick'em fantasyLiveMar 2025CompetitivePick'em/player-vs-house formats (PrizePicks, Underdog) operate under the same Fantasy Sports Act registration as peer-to-peer DFS. Underdog launched its pick'em product in NJ in March 2025 after exiting New York; in September 2026 Underdog surrendered its NJ DFS license (and six others) to instead offer CFTC-licensed prediction-market-style contracts.[15],[16]
Pari-mutuelLiveCompetitiveLive racing continues at Meadowlands Racetrack (East Rutherford) and Monmouth Park Racetrack (Oceanport); off-track betting at Favorites (Woodbridge) and Winners Bayonne. Freehold Raceway and three Favorites OTB parlors closed Dec. 28, 2024. Pari-mutuel wagering was banned in 1894 and re-legalized in 1939.
N.J.S.A. 5:5-22 et seq.

Advance deposit wageringLiveLegalized Sep 2021CompetitiveDGE regulates fixed-odds/advance-deposit wagering in consultation with the NJ Racing Commission; residents may wager by phone/electronic media on races in and outside NJ, and non-residents may wager in person or electronically at NJ tracks.
N.J.S.A. 5:5-168 et seq. (fixed-odds/advance deposit wagering, P.L.2021, c.193)

Charitable gamingLiveMonopoly StateRegulated by the Legalized Games of Chance Control Commission (within Division of Consumer Affairs); bingo/raffles/casino nights/armchair races are only permitted in municipalities that adopted them by referendum, and towns set additional local rules (e.g., Sunday-only play). A 2021 ballot measure (Public Question 2) let all nonprofits, not just veterans'/senior groups, use proceeds for general operations.
N.J.S.A. 5:8-1 et seq. (Raffles Licensing Law); N.J.S.A. 5:8-50 et seq. (Bingo Licensing Law)

Esports bettingLimitedNov 2019CompetitiveA 2021 amendment lets DGE-approved esports tournaments count as "sporting events" sportsbooks can take wagers on; operators must give DGE 72 hours' written notice per new event/wager type. DGE first approved wagering on the League of Legends World Championship in Nov. 2019 (capped at $1,000/bettor, no in-play betting). Esports Entertainment Group holds a transactional waiver as an esports-only operator affiliated with Bally's AC; standard per-bet/payout caps have been reported at $100 wagered / $500 payout, though DGE can adjust them.[18],[19]
Social casinoLiveFree-to-play social casino apps with no cash-value prize redemption are not gambling under NJ law and are unregulated; NJ's 2025 sweepstakes-casino ban (P.L.2025, c.128) expressly carved out promotions with no purchase requirement and prizes capped at $20, preserving conventional social casino.[7]

Legislation

AI outlook · Oct 11, 2026

New Jersey's 222nd Legislature runs through 2027 and has a long list of gambling bills, most still sitting in their referring committees. The ones that have moved include A4002 (published sports wagering rules, passed the Assembly June 30), S3621 (fewer required thoroughbred racing dates, passed the Senate June 30), the micro bet ban A3258, the prediction market surtax bills A5336 and S4447, and the national self-exclusion program bills S2055 and A3689. The prediction market ban bills (A4689, S3692) and sweepstakes and sports ad bills have not advanced.

What to watch: Bills carry over through the end of 2027, so nothing is dead yet; the Legislature typically votes in clusters after the November election and again before the June budget deadline. Prediction market taxation and sports betting limits such as micro bets and incentive-based wagering are the most likely to move.

Next: Needs a Senate Budget and Appropriations hearing, most likely in a fall or lame-duck voting session. Having passed one house makes this one of the likelier bills to move.
