Indiana

Indiana authorizes retail and statewide mobile sports betting, 13 commercial casinos and racinos, one tribal casino, the Hoosier Lottery and licensed daily fantasy sports.
Online casinos are not authorized, and a sweepstakes-casino ban takes effect July 1, 2026.

More detail

Legal framework. Indiana authorizes retail and statewide mobile sports wagering, 13 commercial riverboat/land-based casinos and racinos, one tribal casino, the Hoosier Lottery, charitable gaming, and licensed daily fantasy sports.
Sports betting. Sports wagering is taxed at 9.5% of adjusted gross receipts.
Tribal gaming. The one tribal casino is the Pokagon Band's Four Winds South Bend, which is retail-only.
Online casinos. Online casino gaming (iGaming) is not authorized. Repeated 2025-2026 bills stalled.
Sweepstakes and lottery couriers. In 2026 Indiana enacted a first-in-the-nation-timed sweepstakes-casino ban (HB 1052, effective July 1, 2026). It separately banned lottery courier services (2025 SB 94).
Prediction markets. The Indiana Gaming Commission has so far treated prediction-market platforms (Kalshi, etc.) as outside its jurisdiction and taken no enforcement action, unlike several neighboring states.

Vertical	Status	Launched	Model	Details
Sports (online)	Live	Oct 3, 2019	Competitive	Statewide mobile wagering tethered to a licensed riverboat/racino certificate holder; no separate online-only skins. BetRivers and DraftKings launched online October 3, 2019; FanDuel followed October 22, 2019. Tribal mobile wagering under the Pokagon compact is limited to the 166-acre reservation footprint, not statewide. IC 4-38 [1],[2]
Sports (retail)	Live	Sep 1, 2019	Competitive	Retail sportsbooks at licensed riverboat/land casinos, racinos, and OTBs under HEA 1015 (2019). Pokagon Band's Four Winds South Bend also offers retail-only sports wagering under its tribal-state compact. IC 4-38 [1],[3]
Online casino	Not authorized No statute authorizes real-money online casino games. HB 1432 (2025, 26% tiered AGR tax proposal) never got a Ways & Means vote. A 2026 iGaming amendment was attached to HB 1052 but the committee took no vote on it, and the sponsor shelved iGaming for 2026 in favor of the lottery and sweepstakes-ban bills. Legislative leaders (Speaker Huston) have said they are open to it but no consensus version exists as of October 2026.[4],[5]
Online poker	Not authorized No standalone online poker statute; would require the same igaming authorization that has not passed. Peer-to-peer skill-based poker is explicitly carved out of the 2026 sweepstakes ban, implying licensed live poker rooms/charitable poker continue, but no online real-money poker is authorized.[6]
Commercial casinos	Live	Legalized 1993	Competitive	13 licensed commercial riverboat/land-based casinos and racinos regulated by the IGC (includes two racinos, Hoosier Park and Horseshoe Indianapolis, which added table games after 2019). IC 4-33 [7]
Tribal casinos	Limited	Legalized 2020	Monopoly Tribal	Four Winds South Bend (Pokagon Band of Potawatomi) is Indiana's only tribal Class III gaming facility, operating under a 20-year compact signed by Gov. Holcomb; up to 3,403 gaming positions; sports wagering and mobile wagering confined to the 166-acre tribal property (no statewide mobile). Tribe shares 10% of net slot revenue (8% state / 2% South Bend). Pokagon Band of Potawatomi Indians-Indiana Class III Gaming Compact [8]
Lottery	Live	Oct 28, 1989	Monopoly State	Hoosier Lottery created by 1988 constitutional amendment lifting Indiana's 1851 lottery ban; retail draw games, scratch-offs, and multistate games. IC 4-30 [9]
iLottery	Not authorized HB 1078 (2026) would have authorized online draw-game and e-instant sales (18+, voluntary exclusion) but was pulled from the House floor calendar on Jan. 20, 2026 and died for the session for lack of caucus support.[5]
Daily fantasy	Live	Legalized Jul 1, 2016	Competitive	SEA 339 (2016) legalized and licensed paid fantasy sports contests, enforced by the IGC's Paid Fantasy Sports Division; outcomes must reflect participants' knowledge/skill (IC 4-33-24-9). IC 4-33-24 [10]
VGTs / VLTs	Not authorized Indiana has not authorized video gaming terminals in bars/truck stops/fraternal clubs outside licensed casinos (unlike Illinois); gaming devices outside licensed casinos and charity gaming are prohibited.[7]
Historical horse racing	Not authorized Indiana is not among the states that have authorized HHR machines (Alabama, Arkansas, Kansas, Kentucky, New Hampshire, Virginia, and Wyoming are typically cited); Indiana racinos operate standard slot machines under IC 4-35, not HHR terminals.[11]
Sweepstakes casinos	Prohibited	Legalized Mar 13, 2026 Gov. Mike Braun signed HB 1052 on March 13, 2026 (House passed 87-11 Feb. 2; Senate 37-8 Feb. 18), banning online dual/multi-currency sweepstakes games that simulate casino, lottery, or sports-betting-style gaming. Explicitly exempts Hoosier Lottery promotions and peer-to-peer skill-based poker. IGC may impose civil penalties up to $100,000 per violation and issue cease-and-desist letters; criminal penalties were downgraded to civil in committee. Effective July 1, 2026. HB 1052 (2026) [6],[12]
Prediction markets	Not authorized Changed from "contested" to "not_authorized" on audit (2026-10-10): no Indiana statute authorizes or licenses event-contract trading. As of a May 2026 Indiana Public Broadcasting report, Indiana Gaming Commission officials said prediction markets (e.g., Kalshi) fall under federal CFTC jurisdiction and the IGC has no oversight authority; the Commission has issued no cease-and-desist order. Indiana AG Todd Rokita joined a 44-state AG coalition letter asking the CFTC to disclaim exclusive jurisdiction over sports event contracts and leave regulation to the states, but that is a policy position directed at a federal regulator, not a cease-and-desist, lawsuit, injunction, or ruling against the platforms, so it does not meet the national rule's bar for "contested"; Indiana itself has taken no enforcement action, contrasting with Nevada, Illinois, Connecticut, New York, Ohio, and others that sent C&Ds. Contracts remain available to Indiana residents statewide under claimed CFTC/federal preemption as of this file's as_of date.[13]
Skill games	Not authorized No Indiana statute authorizes unregulated "skill game"/grey machines outside licensed casino and charity gaming. Indiana's unlawful-gambling statute (IC 35-45-5-2) defines gambling as risking money or property for gain where the outcome depends "in whole or in part" on chance or on a "gambling device," a standard broad enough to reach most chance-hybrid terminals. Attorney General Advisory Opinion 2001-09 (Jan. 2002) considered whether a "Skill Slot" machine should be excluded from the gambling code; its final conclusion could not be located in this research, and no recent (2025-26) Indiana litigation or IGC enforcement action on grey machines (unlike neighboring KY, MO, PA) was found.[14],[7]
Card rooms	Not authorized No freestanding card-room statute outside licensed casinos; poker is offered only within IGC-licensed casinos or as charitable/peer-to-peer skill-based poker.[6]
Lottery couriers	Prohibited	Legalized May 2025 SB 94 (2025) bars operation of lottery courier services (e.g., Jackpocket, theLotter, Jackpot) in Indiana unless expressly authorized in writing by the Hoosier Lottery Commission, which the statute does not permit it to grant; unauthorized operation is a Class A misdemeanor, effective July 1, 2025. IC 4-30 (as amended by SB 94 (2025)) [15]
Pick'em fantasy	Limited Competitive	Indiana's DFS statute does not separately classify pick'em/player-vs-house formats; such contests operate under the same IC 4-33-24 paid-fantasy-sports licensing umbrella pending any IGC determination that a given product is more properly sports wagering.[10]
Pari-mutuel	Live Competitive	Live Thoroughbred and Standardbred racing with pari-mutuel wagering at Hoosier Park (Anderson) and Indiana Grand/Horseshoe Indianapolis; both tracks are also racinos with slots/table games. IC 4-31 [16]
Advance deposit wagering	Live	Legalized 2017	Competitive	HB 1350 (2017) authorized advance deposit wagering via licensed Secondary Pari-Mutuel Organizations (SPMOs); bettors must be 21+ and physically located in Indiana. Licensed SPMOs as of July 2026 include Churchill Downs Technology Initiative Co. (TwinSpires/BetAmerica); the roster has shrunk over time (e.g., PointsBet's ADW license lapsed). IC 4-31-7.5; 71 IAC 9 [16]
Charitable gaming	Live	Legalized 1989	Monopoly State	Charity gaming (bingo, raffles, pull tabs, punchboards, tip boards) licensed by the IGC's Charity Gaming Division for qualified 501-exempt nonprofits (over 4,000 licensees); oversight moved from the Dept. of Revenue to the IGC effective July 1, 2006. IC 4-32.2 [7]
Esports betting	Not authorized Indiana's sports-wagering definition (HEA 1015, 2019) expressly excludes wagering on e-sports from "sports wagering," so esports wagering is not authorized under IC 4-38; no other statute authorizes it. IC 4-38-2 [1]
Social casino	Live Pure free-to-play, no-prize-redemption social casino apps fall outside Indiana's gambling definition (IC 35-45-5-2 requires risking something of value for gain). Indiana's 2026 sweepstakes ban targets prize-redeemable dual-currency products (Gold Coins/Sweeps Coins) and does not reach no-prize social casino play; no statute or regulator statement restricting pure social casino apps specifically was located.[6]

Legislation

AI outlook · Oct 11, 2026

Indiana's big 2026 item is HB1038, signed March 4, which sets up an inland casino license for Allen, DeKalb or Steuben County, contingent on local voter approval. The three counties must place the question on the 2026 general election ballot, so the next step arrives soon. Other tracked items are a symbolic horse racing resolution and a 2025 alcohol and gaming bill that stalled.

What to watch: Watch the November 3, 2026 ballot results in Allen, DeKalb and Steuben counties; a yes vote lets the Indiana Gaming Commission start the application process with its $500 million investment and $150 million fee requirements. Indiana's next regular session starts in January 2027.
