Tax rate

RateSinceNotes
51% GGR (online)Jan 8, 2022Confirmed against primary text: § 1367-a(7)(d) does not fix a numeric rate; it requires winning mobile platform providers to remit 'the highest percentage of gross gaming revenue from mobile sports wagering contained in an applicant's bid.' 51% is the rate that resulted from the 2021 competitive-bid process (all 2022 licensees bid 51%), not a statutory figure. Among the highest mobile sports betting tax rates in the US; funds education plus $5M/yr youth sports and $6M/yr problem-gambling carve-outs. Flat at 51% since the Jan. 8, 2022 launch, no change found.[1],[2]
10% GGR (retail)Jul 16, 2019Confirmed against primary text: § 1367(7) reads "For the privilege of conducting sports wagering in the state, casinos shall pay a tax equivalent to ten percent of their sports wagering gross gaming revenue, excluding sports wagering gross gaming revenue attributed to mobile sports wagering offered pursuant to section thirteen hundred sixty-seven-a of this title." Flat 10% since the first legal retail sports bet (Rivers Casino, Schenectady, 2019-07-16, per contemporaneous press reports); no rate change found. Previously only recorded indirectly via the casino_commercial "table games (including retail sports wagering operations)" row below, which is the wrong vertical for this tax.[3]
