Michigan
- Michigan has one of the broadest legal markets in the country, with online sports betting, iGaming and an iLottery.
- Online licenses are tied to the three Detroit casinos and 12 tribes, and tribal Class III casinos operate under 12 compacts.
- The state polices unlicensed sweepstakes casinos and won a restraining order against Kalshi in 2026.
More detail
- Online sports betting and iGaming. Competitive online sports betting and iGaming are tethered to the three Detroit commercial casinos and 12 federally recognized tribes. Each is limited to one online "skin".
- Lottery. The lottery includes one of the oldest and largest iLottery programs in the country.
- Fantasy sports. Daily fantasy sports are regulated. Pick'em-style contests were banned by rule in 2023.
- Tribal gaming. Tribal Class III casinos operate under 12 state-tribal compacts.
- Taxes. Igaming and sports tax rates have not changed since the 2019 legalization laws took effect. Legislative and budget proposals from 2024 to 2026 to raise them have so far failed to pass.
- Online casinos and sweepstakes. The Michigan Gaming Control Board (MGCB) has aggressively policed unlicensed markets. It has sent cease-and-desist letters to sweepstakes-casino operators since 2023-2024.
- Prediction markets. In 2026 Attorney General Dana Nessel sued Kalshi. She won a temporary restraining order halting its sports-event-contract operations under the Lawful Sports Betting Act.

| Sports (online) | Live | Jan 22, 2021 | Competitive | Online/mobile sports betting is tethered to the 3 Detroit commercial casinos and tribes with compacts; each may operate (or partner for) one online skin. Flat 8.4% tax on adjusted gross sports betting receipts for commercial operators; tribal operators pay an equivalent rate under their compacts. Lawful Sports Betting Act, 2019 PA 149, MCL 432.401 et seq.; MCL 432.407 (tax rate) [1],[2] |
| Sports (retail) | Live | Mar 11, 2020 | Competitive | Retail sportsbooks authorized at the 3 Detroit commercial casinos and tribal casinos. Detroit casinos pay 8.4% tax on adjusted gross sports betting receipts, split 3.78 points to the state and 4.62 points to the City of Detroit. Lawful Sports Betting Act, 2019 PA 149, MCL 432.401 et seq. [3],[4] |
| Online casino | Live | Jan 22, 2021 | Competitive | Online casino (slots, table games, live dealer) tethered to the 3 Detroit commercial casinos and compacted tribes; one skin per land-based casino. Graduated commercial tax of 20-28% of adjusted gross receipts (see tax_rates); tribal operators are taxed under a parallel structure in MCL 432.314(2) tied to compact terms rather than the commercial tiers. Lawful Internet Gaming Act, 2019 PA 152, MCL 432.301 et seq.; MCL 432.314 (tax tiers) [5],[2] |
| Online poker | Live | Jan 22, 2021 | Competitive | Licensed as part of the igaming skin (no separate online-poker-only license). Michigan is a member of the Multi-State Internet Gaming Agreement (MSIGA) with New Jersey, Delaware, Pennsylvania, Connecticut and West Virginia for shared online poker liquidity; could not independently verify exact join date this session. Lawful Internet Gaming Act, 2019 PA 152, MCL 432.301 et seq. [5] |
| Commercial casinos | Live | 1999 | Competitive | Voters approved Proposal E in November 1996, authorizing exactly 3 commercial casinos, all in Detroit (Greektown Casino, MotorCity Casino, MGM Grand Detroit). No other commercial casino licenses are authorized anywhere else in the state. Michigan Gaming Control and Revenue Act, 1996 Initiated Law 1, MCL 432.201 et seq. [6] |
| Tribal casinos | Live | Legalized 1993 | Monopoly Tribal | 12 of Michigan's federally recognized tribes operate Class III casinos (nearly two dozen facilities) under individual compacts. First 7 compacts signed 1993 after a federal consent judgment; the last holdout, the Gun Lake Band, received trust land and its compact took effect April 2009. Compacts generally include geographic exclusivity in exchange for 2% revenue-share payments to local governments on electronic games of chance, plus payments to the state; terms vary by tribe and some have been renegotiated (e.g., Nottawaseppi Huron Band/FireKeepers 2009 sliding-scale amendment; Hannahville Potawatomi agreement running to 2042). Indian Gaming Regulatory Act (federal); individual Tribal-State Gaming Compacts [6],[7] |
| Lottery | Live | Nov 13, 1972 | Monopoly State | Michigan Lottery sales began with the "Green Ticket" game on November 13, 1972, established under 1972 PA 239. McCauley-Traxler-Law-Bowman-McNeely Lottery Act, 1972 PA 239, MCL 432.1 et seq. [8] |
| iLottery | Live | Aug 2014 | Monopoly State | Michigan was among the first states to sell lottery products online, relaunching its website in August 2014 to add online draw-game ticket purchases and virtual instant ("e-instant") games. McCauley-Traxler-Law-Bowman-McNeely Lottery Act, MCL 432.1 et seq. [8] |
| Daily fantasy | Live | Legalized Dec 20, 2019 | Competitive | Licensed peer-to-peer fantasy contests regulated by MGCB; initial license fee $10,000, annual renewal $5,000 (MCL 432.503). Casino licensees and qualifying tribal gaming/sports-betting/igaming licensees may offer fantasy contests without a separate license. Small private contests (<=15 players, <=$10,000 total entry fees/year, >=95% payout) are exempt from licensing. Fantasy Contests Consumer Protection Act, 2019 PA 157, MCL 432.501 et seq. [9] |
| VGTs / VLTs | Not authorized | Michigan has not authorized video gaming terminals/VLTs in bars, truck stops or similar off-casino locations (unlike IL, PA, MT, LA); gaming devices outside the 3 licensed commercial casinos and compacted tribal casinos remain generally prohibited. Secondary source only.[10] | ||
| Historical horse racing | Not authorized | No historical horse racing (HHR) authorization has been enacted. SB 661 (2019) passed the Senate 38-0 and would have authorized HHR terminals at licensed tracks (1% wagering tax), and a 2021 four-bill package including SB 396 (Sen. Lauwers) would have authorized and taxed HHR at 19% of adjusted gross receipts as a pari-mutuel-style electronic gaming system, but neither bill was enacted into law. No track currently holds a live-racing license (Northville Downs closed Feb. 2024), further narrowing any practical path to HHR absent new legislation.[11],[12] | ||
| Sweepstakes casinos | Prohibited | Legalized Jan 2024 | MGCB treats dual-currency sweepstakes casinos as unlicensed online lotteries/raffles rather than legal promotions. AG Nessel's office secured an assurance of discontinuance against Golden Hearts Games in September 2023. MGCB sent cease-and-desist letters to Stake.us, PredictionStrike and VGW LuckyLand in January 2024, and to "One Country" (OC Media Holdings LLC) in August 2024; unlicensed gambling under the Gaming Control and Revenue Act can carry imprisonment and/or a fine up to $100,000. As of mid-2026 no sweepstakes-casino platform is reported to operate legally in Michigan per secondary tracking (not independently verified against a formal MGCB order list). Michigan Gaming Control and Revenue Act, MCL 432.201 et seq.; Michigan Penal Code; Lawful Internet Gaming Act, MCL 432.301 et seq. [10],[13],[14] | |
| Prediction markets | Contested | MGCB filed comments with the CFTC in May 2025 arguing Kalshi's sports-event contracts violate Michigan law, without itself joining the states that sent cease-and-desist letters to Kalshi at that time. In March 2026, AG Dana Nessel sued Kalshi in Ingham County Circuit Court alleging violation of the Lawful Sports Betting Act; Kalshi's attempt to remove the case to federal court was denied on remand. On June 29, 2026 the Ingham County Circuit Court granted a temporary restraining order halting Kalshi from "engaging in or advertising its internet sports betting operation in Michigan" while the litigation continues; MGCB subsequently withdrew from the National Council on Problem Gambling over its Kalshi partnership (July 2026). On Sept. 1, 2026, Ingham County Circuit Judge Rosemarie Aquilina signed a preliminary injunction barring Kalshi from offering, clearing, settling or facilitating any contract that could be classified as online sports betting in Michigan, with a $500,000/day fine for geofencing violations; the injunction is expected to remain in effect until final judgment. Michigan sits in the 6th Circuit. On 2026-09-25 that circuit decided KalshiEX LLC v. Schuler (Ohio, No. 26-3196) together with KalshiEX v. Orgel (Tennessee, No. 26-5235), ruling against Kalshi on CEA-swap and preemption grounds; this is binding precedent in Michigan's circuit and supports the state court's injunction, though it is not itself a Michigan case and no Michigan source was found copying its caption into this file. Consistent with 9th Cir. (NV, decided 2026-08-28, against Kalshi); contrasts with 3rd Cir. (NJ, decided 2026-04-06, for Kalshi).[15],[16],[17],[18] | ||
| Skill games | Not authorized | No Michigan statute authorizing unregulated skill-based "grey machine" gaming terminals was identified; general gambling-device prohibitions in the Michigan Penal Code and Gaming Control and Revenue Act apply. Secondary source only; could not find Michigan-specific skill-game litigation comparable to Pennsylvania/Georgia this session.[10] | ||
| Card rooms | Not authorized | Michigan does not authorize free-standing card rooms outside the 3 licensed Detroit commercial casinos and compacted tribal casinos; general prohibitions in the Michigan Penal Code and Gaming Control and Revenue Act apply to unlicensed card games for money. Secondary source only.[10] | ||
| Lottery couriers | Not authorized | Jackpocket's own state-availability listing excludes Michigan, with a secondary tracker noting that Michigan residents instead have the Michigan Lottery's own official online ticket-sales channel (one of the earliest state-run iLottery programs, since Aug. 2014) in place of a third-party courier. No Michigan statute or MGCB/Lottery guidance was identified affirmatively licensing a lottery-courier service.[19] | ||
| Pick'em fantasy | Prohibited | Legalized Aug 2023 | MGCB adopted rules in August 2023 prohibiting pick'em-style fantasy contests (selecting 2+ athletes and betting over/under on projected stat totals), the format used by PrizePicks and Boom Fantasy; Underdog Fantasy exited the Michigan DFS market over the rule change. Secondary source only for the rule's exact date/scope; recommend verifying against MGCB's adopted administrative rule text.[20] | |
| Pari-mutuel | Limited | Hybrid | Live horse racing and pari-mutuel wagering regulated under the Horse Racing Law of 1995; Executive Order 2009-45 abolished the standalone Office of Racing Commissioner and transferred its duties to the MGCB's executive director, effective January 17, 2010. Michigan's live racing industry has contracted sharply (most historic tracks, e.g. Hazel Park, closed); could not confirm the current count of active licensed tracks this session. Horse Racing Law of 1995, 1995 PA 279, MCL 431.301 et seq. [6] | |
| Advance deposit wagering | Contested | Competitive | Michigan's Horse Racing Law ties simulcast/advance-deposit wagering to a live race meet at a licensed track; Michigan's last track, Northville Downs, closed Feb. 2024, leaving no licensed live-racing venue. On Dec. 23, 2024 the MGCB directed all 4 licensed ADW facilitators (Xpressbet, TwinSpires, NYRAbets, TVG/ODS Technologies) to cease Michigan account wagering effective Jan. 1, 2025, reasoning ADW requires a live in-state meet that no longer exists; Xpressbet, NYRAbets, and TVG complied. TwinSpires (Churchill Downs) refused, was summarily suspended by the MGCB on Jan. 9, 2025, and sued the board in federal court over the track-linkage theory; per an Aug. 2025 trade report, the 6th Circuit upheld a lower-court ruling letting TwinSpires continue operating pending the litigation. Status is therefore contested rather than cleanly operational or not_authorized: one major ADW (TwinSpires) continues to accept Michigan wagers under an ongoing court order while the state's own position is that ADW is not currently authorized absent a live in-state meet. Horse Racing Law of 1995, 1995 PA 279, MCL 431.301 et seq. [21],[22] | |
| Charitable gaming | Live | Monopoly State | Bingo, raffles and "millionaire parties" (charitable casino nights) are licensed and regulated by the Michigan Lottery (not MGCB) under the Bingo Act. Traxler-McCauley-Law-Bowman Bingo Act, 1972 PA 382, MCL 432.101 et seq. [23],[6] | |
| Esports betting | Limited | Competitive | The Act's "athletic event" definition (MCL 432.403) covers sports activity involving athletic skill and excludes casino games, youth sports and fantasy contests, but also allows wagering on "other events approved by the board." Esports is not separately named in statute; whether specific esports titles/events have been board-approved for wagering was not confirmed this session. Lawful Sports Betting Act, 2019 PA 149, MCL 432.403 (definitions) [24] | |
| Social casino | Live | Pure free-to-play, no-cash-prize-redemption social casino apps are not regulated as gambling in Michigan and are not targeted by MGCB enforcement, which has instead focused specifically on apps that let users buy in and cash out real money (e.g. the Oct. 2024 cease-and-desist to Papaya Gaming's 21 Cash, Bingo Cash, Bubble Cash, and Solitaire Cash apps, cited under the Lawful Internet Gaming Act and the Michigan Penal Code's unauthorized-gambling prohibition). A tracker source notes Michigan has not adopted legislation specifically limiting social or sweepstakes-casino operations as some other states have, and that applying existing law to pure social casino play (no purchase, no cash-out) has not been tested in Michigan courts.[25],[26] |

Legislation
- Summary of significant pending gambling legislation this session
- SB 1193/1194 (2024, Sens. Singh & Moss) would have raised the online sports betting tax from 8.4% to 8.5% and each igaming tier by 1 point (to 21/23/25/27/29%), plus shifted revenue-distribution shares; both bills stalled in the Senate Government Operations Committee and did not carry over into the 2025-2026 session as introduced. Governor Whitmer's later budget proposal sought a new top iGaming bracket (36% on AGR above a high threshold, up from 28%), a per-wager sports betting tax, and removal of sportsbooks' promotional-credit deduction, projected to raise roughly $195 million/year combined; not enacted as of October 2026.[27],[28]
