Idaho

More detail
  • Legal framework. Idaho's Constitution (Art. III, §20) declares gambling contrary to public policy and bans it outright. There are three enabling-legislation carve-outs: a state lottery, pari-mutuel betting, and charitable bingo/raffles. None of them may take the form of casino-style games, including electronic imitations of them.
  • Tribal gaming. Voters' 2002 Proposition 1 let tribes install "tribal video gaming machines" (statutorily defined as not slot machines) under their federal compacts. Four tribes (Coeur d'Alene, Nez Perce, Kootenai, Shoshone-Bannock) have the state's only casino-style gaming.
  • Historical horse racing. A 2013 law authorized historical horse racing (HHR) terminals at non-tribal tracks. It was repealed in 2015 after the Idaho Supreme Court held Governor Otter's veto was filed too late (Coeur D'Alene Tribe v. Denney), shutting down roughly 250 machines.
  • Sports betting and daily fantasy sports. Idaho has no sports betting and no commercial casinos. A 2016 Attorney General opinion that daily fantasy sports is illegal gambling drove DraftKings and FanDuel out of the state.
  • Sweepstakes. Sweepstakes casinos operate, if at all, only in no-cash-value "Gold Coin" form, per an industry sweepstakes tracker.
  • Lottery. No iLottery or lottery-courier service exists.
  • Prediction markets. Idaho sits in the Ninth Circuit, which ruled against Kalshi in a Nevada case (August 2026). No Idaho-specific prediction-markets enforcement action has been identified.

Tribal casinosLimitedLegalized Nov 5, 2002Monopoly Tribal2002 Proposition 1 authorizes tribes to operate "tribal video gaming machines," defined by statute as not slot machines, under their IGRA compacts. Casinos operate on the Coeur d'Alene, Nez Perce, Kootenai, and Shoshone-Bannock reservations; machine counts are capped at pre-2002 levels plus 25% with 5%/yr growth thereafter, and tribes contribute 5% of net gaming income to local schools. iLotteryNot authorizedIdaho Lottery tickets are sold only through licensed retailers; its site shows no online ticket-purchase option.[8]
Daily fantasyProhibited2016 Idaho AG opinion concluded paid daily fantasy sports contests are illegal gambling under §18-3801's definition (risking value for gain contingent on a sporting event, in part); DraftKings and FanDuel stopped serving Idaho residents by May 1, 2016.

Historical horse racingRepealedLegalized 20132013 law authorized "instant racing"/HHR terminals at non-tribal tracks (Les Bois Park, Greyhound Park); ~250 machines installed. The 2015 Legislature passed S.B. 1011 to repeal that authorization; Gov. Otter vetoed it, but the Idaho Supreme Court held in Coeur D'Alene Tribe v. Denney (Sept. 10, 2015) that the veto was filed too late, so S.B. 1011 became law automatically and the machines were removed.
2013 Idaho Sess. Laws; S.B. 1011 (2015)
[11]
Sweepstakes casinosNot authorizedNo dedicated sweepstakes statute; the state relies on the general gambling ban and constitutional casino-style-game bar. Secondary trackers report sweepstakes operators cannot offer cash-redeemable prizes to Idaho residents, leaving only no-cash "gold coin" play. Secondary source only for the operational detail.
Idaho Const. art. III, §20; Idaho Code §18-3801
[1],[2],[12]
Prediction marketsNot authorizedChanged from "contested" to "not_authorized" on audit (2026-10-10): Idaho's AG joined a multistate 2025 letter asking the CFTC to recognize state jurisdiction over sports-related event contracts, but that is a policy position directed at a federal regulator, not a cease-and-desist, lawsuit, injunction, or ruling against the platforms, so it does not meet the national prediction-markets rule's bar for "contested." No Idaho-specific suit or C&D was found; Kalshi and similar CFTC-registered event-contract platforms are reportedly accessible to Idaho residents statewide under claimed CFTC/federal preemption with no confirmed Idaho enforcement action as of October 2026. Idaho sits in the Ninth Circuit, which ruled against Kalshi in KalshiEX LLC v. Assad (Nevada, Aug. 28, 2026) -- unlike the pro-Kalshi Third Circuit (NJ, Apr. 2026) -- though that ruling arose from Nevada's enforcement, not Idaho's, so it does not itself constitute Idaho state action.[13]
Skill gamesLimitedConfirmed via the statute text itself (fetched directly): "gambling" does not include "[b]ona fide contests of skill, speed, strength or endurance in which awards are made only to entrants or the owners of entrants" -- so true skill contests are exempt from the gambling ban. No Idaho-specific litigation or enforcement action concerning chance- based "grey machines" marketed as skill games was found in this research pass; such devices would likely fall back under the general gambling/slot-machine prohibition (§§18-3801, 18-3810) rather than this narrow exemption.
Idaho Code §18-3801(1)
[2]
Card roomsProhibitedNo stand-alone card rooms exist outside tribal facilities.
Idaho Const. art. III, §20; Idaho Code §18-3801
[1],[2]
Lottery couriersNot authorizedIdaho Lottery's official site (fetched directly) contains no reference to online ticket purchase, subscription, or third-party courier services (e.g., Jackpocket); tickets are sold only through licensed retailers, consistent with the ilottery finding.[8]
Pick'em fantasyProhibitedNo Idaho-specific ruling on pick'em formats found; the same AG rationale (any paid, chance-contingent fantasy contest is gambling) would apply, and no operator is known to serve Idaho.[2]
Pari-mutuelLiveMonopoly StateConstitutional exception; Idaho State Racing Commission licenses live and simulcast race meets under the Horse Racing Act (IDAPA 11.04.08).
Idaho Const. art. III, §20; Idaho Code §54-2507; Idaho Code §54-2512

No tax or licensing regime; true skill contests fall outside Idaho's gambling definition entirely under Idaho Code § 18-3801(1)'s bona fide contests-of-skill exemption, so no revenue tax or device fee applies to them. Chance-based 'grey machines' marketed as skill games are not exempted and would instead fall under the general gambling/slot-machine prohibition (§§ 18-3801, 18-3810), which imposes no tax because the activity is simply illegal.

Legislation

AI outlook · Oct 11, 2026

Idaho's 2026 session produced only two lottery-related laws: a ban on bulk lottery ticket purchases and the lottery's fiscal 2027 appropriation. Both are signed, and the session ended in April. Idaho continues to prohibit sports betting, commercial casinos and online lottery, and no bill to change that is pending.

What to watch: The Legislature convenes in January 2027. Expansion of legal gambling is unlikely there; watch instead for any follow-up on lottery rules or prediction market and sweepstakes enforcement.
