  • Legal framework. Hawaii bans gambling in essentially all forms under HRS §712-1220 et seq. (Hawaii Penal Code, Part III). The single narrow exception is "social gambling" played on equal terms in a private, non-commercial setting among players at or above the age of majority (18) (§712-1231). Along with Utah, it is one of only two U.S. states with no legal, state-authorized gambling of any kind.
  • No other exceptions. Unlike most states, Hawaii carves out no exception for a state lottery, charitable bingo/raffles, pari-mutuel racing, tribal gaming, or skill-game machines. Hawaii has no federally recognized reservation through which a tribe could negotiate an IGRA compact. The statutory "contest of chance" test applies "notwithstanding that skill ... may also be a factor," so skill-game machines are prohibited.
  • Daily fantasy sports. A 2016 Attorney General opinion (No. 16-1) concluded daily fantasy sports is illegal gambling.
  • Pending legislation. Lawmakers have made repeated, increasingly close runs at legalizing online sports betting. HB 1308 passed both chambers in 2025 before dying in conference committee. HB 2570/SB 3303 advanced through House and Senate committees in 2026 before stalling. A 2024 law (Act 249) scheduled a repeal-and-reenactment of the "advance gambling activity" definition effective July 1, 2029.
  • Prediction markets. Prediction markets (Kalshi) are, by contrast, a live, statutorily grounded exception. The gambling statute's own securities/commodities exclusion lets Kalshi legally operate with no enforcement action. A 2026 bill (HB 2198) to close that gap passed a House committee unanimously but did not clear the Senate. Hawaii sits in the Ninth Circuit, which ruled against Kalshi on CFTC-preemption grounds in a Nevada case (August 28, 2026). That ruling does not affect Hawaii's own state-law-based position.
